Terms of Service

These terms govern your engagement of Terra Firma Israel for a property inspection and your use of this website. By submitting a booking request or inquiry you agree to them. They apply together with our Engineering & Inspection Disclaimer and Privacy Policy, and are governed by the laws of the State of Israel.

Who we are and how these terms apply
Terra Firma Israel ("we", "us") arranges and delivers pre-purchase and pre-handover property inspections in Israel, performed by engineers registered with the Israeli Registrar of Engineers and Architects under the Engineers and Architects Law 5718-1958. We are an Israeli business currently completing incorporation; our company registration details will be published on this page once incorporation completes, and your engagement will continue with the incorporated entity on these same terms.

When you submit a booking request and tick the acceptance box, these terms apply to your engagement, and we send you a written confirmation of the engagement details by email, including your cancellation rights under the Israeli Consumer Protection Law 5741-1981.

The service
We offer three tiers, described in full on the pricing page: Standard (full physical inspection, an English-language report human-translated and reviewed by native-English engineering staff, and high-resolution photography), Premium (adding a 360° HD digital-twin walkthrough, a dimensioned floor plan, and spatial defect tagging), and Estate (a bespoke engagement, scoped and quoted privately). Every tier includes ongoing English-language Q&A support from the engineering team, by email and WhatsApp, relating to your inspection and report. The inclusions published on the pricing page at the time of your booking form part of your engagement.

Scope of the inspection
Inspections are non-invasive and primarily visual. The engineer examines the conditions reasonably accessible and observable on the date of the visit. An inspection does not include opening walls, floors, or ceilings, dismantling fixed elements, or assessing components that are concealed, inaccessible, or obstructed at the time of the visit, unless expressly agreed in writing. Findings describe the property's condition at a single point in time; defects can be latent or seasonal.
The report is a professional engineering opinion — not a warranty or guarantee of the property's condition, a valuation, a survey of title, or legal advice. The full description of the report's nature, scope, and limitations is set out in the Engineering & Inspection Disclaimer, which forms part of these terms. This section defines what the service is; it is not a limitation of our responsibility for performing it with professional skill and care.

Your presence and property access
Most of our clients are abroad, and your presence at the inspection is not required. By booking, you authorize us and the assigned engineer to coordinate access directly with the seller, agent, occupant, or your attorney, and to communicate with them as needed for scheduling. Arranging lawful access to the property remains your responsibility. If the engineer cannot gain access at the agreed time through no fault of ours, the visit fee in Section 8 applies and a re-visit is booked as a new appointment.

Pricing and VAT
All published prices are stated in the currency shown and are inclusive of Israeli VAT (Ma'am) at the prevailing statutory rate — the price you see is the final price. A Complexity surcharge applies to larger properties based on built area, as published on the pricing page; properties of 250 sqm or more are scoped as Estate engagements and quoted privately. The price of a confirmed booking is fixed at confirmation: later changes to published pricing never affect an existing engagement.
Because the service concerns real estate located in Israel, Israeli VAT applies to all clients, including foreign residents; there is no VAT exemption for overseas buyers. Your invoice is a lawful Israeli tax invoice, denominated in NIS as required by law, and states the amount in your quoted currency.

Payment — after the inspection
No payment is required to book. Your booking request reserves the engineer's calendar; we confirm scope and propose dates within one Israeli business day. After the inspection we send a single payment request for the full fee, VAT itemized, due on receipt. The digital deliverables (the full report, the 360° walkthrough where applicable, and spatial defect tags) are released the moment payment clears; until payment we may withhold them. During our introductory period, invoicing and payment processing may be handled on our behalf by the licensed Israeli engineering practice performing the inspection; the invoice identifies the issuing entity. We do not store your card details.

Scheduling and delivery
Business days are Israeli business days (Sunday to Thursday, excluding Israeli public holidays). We aim to respond to booking requests within one business day, and to deliver the report within 24 hours of the inspection visit, released on payment clearing (Section 6). These windows — like all scheduling and delivery windows quoted on the site — are good-faith targets that depend on engineer availability and timely property access; they are not contractual deadlines unless expressly agreed in writing.

Cancellation and rescheduling
Your statutory right: under the Israeli Consumer Protection Law 5741-1981 (distance selling), you may cancel within 14 days of booking (or of receiving the written confirmation, whichever is later), provided the cancellation is made at least two business days before the scheduled inspection date. Because nothing is paid at booking, there is nothing to refund, and we waive the statutory cancellation fee. If you are a senior citizen (65+), a new immigrant, or a person with a disability, and the booking involved direct dialogue with us (including by phone or chat), the cancellation window is four months, on the same conditions.
Beyond the statute: you may cancel or reschedule free of charge at any time up to two business days before the scheduled visit — whether or not the 14-day window has passed.
Late cancellation or failed access: an engineer is dispatched on a fixed date. If you cancel less than two business days before the visit, or the engineer attends and cannot gain access through no fault of ours, a visit fee of 50% of your package fee (VAT inclusive) applies, reflecting the engineer's reserved day and mobilization; a re-visit is booked as a new appointment at the published price.
If we cancel: if we cancel or fail to attend, or the service is defective or not as described, you owe nothing, and any amount already paid is refunded in full within 14 days by the method you paid with. To cancel, write to us by email, WhatsApp, or the contact form. Statutory cancellation rights always apply where they give you more.

The report: ownership, use, and sharing
Copyright in the report and all deliverables remains ours. The report is prepared solely for you, for use in connection with the inspected property, and we accept no responsibility to anyone else who relies on it. You may share it with your attorney, mortgage lender, and professional advisers, with contractors quoting remediation of its findings, and you may submit it in legal or regulatory proceedings concerning the property. Any other transfer, publication, or commercial use requires our prior written consent. The engineer's signed Hebrew-language report is the operative document for any Israeli proceeding, as described in the Disclaimer. Walkthrough links are hosted for the period stated for your tier (Premium: twelve months) unless otherwise agreed; you are encouraged to download your report for your records.

Complaints, and if you believe we missed something
If you are unhappy with any part of the service, write to office@terrafirmaisrael.com. We acknowledge complaints within two business days, a senior engineer reviews every complaint about report findings, and we aim to give you a substantive written response within 14 days.
If you believe a finding was missed or wrong, please tell us as soon as practical — where possible before remediation works begin — so we can re-inspect or assess the condition from photos and video. This helps us put things right quickly; it does not condition or limit your legal rights.

Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or in connection with an engagement is limited to the fees paid (or payable) for that engagement, and we are not liable for indirect, consequential, or loss-of-bargain damages. Nothing in these terms excludes or limits liability that cannot be excluded or limited under mandatory Israeli law — including under the Consumer Protection Law 5741-1981 — or liability for death or personal injury caused by negligence, or for fraud or willful misconduct.

Website content and intellectual property
The content of this website — text, images, sample materials, and design — is our property or used under license, and is provided for your personal, non-commercial use. It is general information about the service, not professional advice about any specific property. The sample report is provided for evaluation only and may not be republished.

Events outside our control
If an inspection cannot safely or lawfully proceed — for reasons such as the security situation, extreme weather, hazardous conditions at the property, or engineer illness — we may reschedule with prompt notice and no charge to you. If we cannot provide the service within a reasonable time, you may cancel and owe nothing.

Governing law and jurisdiction
These terms are governed by the laws of the State of Israel, and the competent courts of Israel have non-exclusive jurisdiction. Nothing in this section deprives you of any mandatory consumer protection, or of the right to bring or defend proceedings in your country of residence where applicable law grants it. These terms do not require arbitration.

Changes to these terms
We may update these terms from time to time. The version in force when you engage us governs your engagement; changes apply only to future bookings and never retroactively to a confirmed engagement.

General
These terms, the Engineering & Inspection Disclaimer, the Privacy Policy, and your written booking confirmation form the whole agreement for your engagement. If any provision is held invalid, the rest remain in force. A failure to enforce a provision is not a waiver of it. Notices are given by email to the address you provided.
